Smart Glasses, Dumb Move: FINRA Bars Rep for Cheating His Way Through Series 6

By Mari Nicholson

The Financial Industry Regulatory Authority has barred Jacob Spencer, a former registered representative at NYLIFE Securities LLC, after finding he used internet-enabled eyeglasses to access test material during the Series 6 exam, according to a letter of acceptance, waiver and consent the regulator accepted Aug. 18.

Spencer, who first associated with NYLIFE Securities in June 2025, wore eyeglasses with electronic modifications to connect to the internet and pull up material to help him answer questions during the February 2026 exam, according to the AWC.

Before the test began, Spencer had attested that he would abide by FINRA’s rules of conduct for exam takers, which bar the use of electronic devices and modified eyewear other than FINRA-approved accommodations.

FINRA found that Spencer’s conduct violated Rule 1210.05, which governs conduct during representative and principal exams, and Rule 2010, which requires associated persons to observe high standards of commercial honor and just and equitable principles of trade. Spencer neither admitted nor denied the findings.

NYLIFE Securities reported that Spencer voluntarily left the firm Feb. 26. As part of the settlement, Spencer agreed to a bar from associating with any FINRA member in any capacity, which took effect when FINRA accepted the AWC.

The case is at least the third exam-cheating case AltsWire has reported in recent years, and the first to involve internet-connected eyewear rather than a phone. FINRA barred a former J.P. Morgan representative in 2025 for hiding a cellphone in a restroom toilet-seat-cover dispenser to access study materials and ChatGPT during a Series 66 exam. Separately, FINRA sought sanctions against a former MassMutual-affiliated representative accused of using a phone to access unauthorized materials during a remote Securities Industry Essentials exam, though that representative failed the test regardless.
