Most recently, Anya Coverman, president and chief executive officer of the Institute for Portfolio Alternatives, advocated for the long overdue reform of the accredited investor definition. She noted that investors and their financial advisers are looking for a fresh approach that considers an investor’s sophistication and investment experience rather than a one-size-fits-all rule. Lisa Gok, chief legal officer of Cetera Financial Group, recommended that financial firms embrace the most stringent state regulations to build trust, minimize risk, and stay ahead of future changes triggered by shifts in federal oversight. How can advisers best navigate the risks of off-channel communications? Noting that the SEC’s off-channel communications sweep has resulted in more than $2 billion in penalties against more than 100 firms since 2021, Tiffany Duncan-Magri, regulatory adviser of Smarsh, discussed modern compliance, i.e., balancing immediate communication needs against regulatory requirements. She shared how to stay ahead as enforcement priorities likely shift. Read more.

John Grady, president of the Alternative & Direct Investment Securities Association, i.e., ADISA, hypothesized myriad policy changes and outcomes related to a second Trump administration plus Republican control of both chambers of Congress. Grady examined the intersections of alternative investments with regulatory shifts, tax cuts, opportunity zones and commercial real estate, among other topics. Read more.

Last but not least, Greg Friedman – managing principal and chief executive officer of Peachtree Group – kicked off 2025 with a look at the “new game,” i.e., a new dawn for commercial real estate. He predicts that savvy and patient players will have the most success in the still vulnerable space and that smart investors who can capitalize on mispriced risk and outdated valuations may best reap the benefits of an uncertain landscape.
